Terms and Conditions
  1. There are no guarantees as to the quality, authenticity, or condition of the items sold. Everything will be sold “as is, where is” unless so stated by the auctioneer at the time of the auction. All coins are guaranteed authentic unless stated otherwise. Silver, Sterling, & Gold is guaranteed to be the fineness listed unless stated otherwise by the auctioneer.
  2. The auctioneer reserves the right to pass any item if, in the auctioneer's opinion, there is no appreciable opening bid. The bidding shall be regulated at the absolute discretion of the auctioneer.
  3. The auctioneer reserves the right to divide any lot, to combine any two or more lots or to withdraw any item at any time from the auction.
  4. Once an item is sold, it becomes the buyer's property and responsibility, no exceptions, unless the items are being held in a security area until paid for. All items are sold for immediate removal.
  5. If an item has a reserve from a consignor, the auctioneer may bid on behalf of the consignor. No  consignor may bid on his or her own items.
  6. A 13% buyer's premium, reduced to 10% for cash or approved check will be charged on each lot as part of the purchase price. Payment is due on the sale day. Cash or good check, Credit & Debit cards will be accepted as payment. All payments are due in U.S. Funds.
  7. All bidders are required to register for a bidding number. DownEast Auctions requires full name, address and telephone number of each bidder, and may require (a) provide bank/ or other credit references and a valid ID; (b) pay the full purchase price before removing an item from the premises and may hold items until buyers check clears our bank. sales are subject to Maine State sales tax of 5.5% unless the buyer has a valid resale tax number.
  8. The highest bidder for each lot shall be the buyer . Should a dispute arise during or after the auction as to the buyer or the price, the sale record shall be conclusive. In the event of any dispute the auctioneer shall have absolute discretion to determine the dispute and the disputed lot may be re-offered for sale  as the auctioneer deems fit.
  9. The auctioneer assumes no responsibility for accidents, theft, etc.
  10. Any announcement made by the auctioneer on the day of the auction supersedes the conditions stated above.
  11. The Auction Company when acting as agents only is not responsible for the acts of its principals.
  12. This auction operates in accordance with the provisions of the Uniform Commercial Code and Maine State Law
By registering and accepting a bidding number, you have signed a written binding contract agreeing to these Conditions of Sale. If you do not agree to these Conditions of Sale, please return your bidding card to the Clerk.

Phone & Absentee Bid Procedures:
1) Absentee bidding for anyone unable to attend the auction in person will be carried out by DownEast Auctions without any extra charge. Bids must be received in writing (on our forms) at least 1 hour before the start of the auction. DownEast Auctions is not  liable for errors or omissions in executing absentee bids. We cannot guarantee to execute written bids received less than 1 hour before the start of the auction. If two absentee bidders bid the same amount for the same lot, the first bid received shall take precedence. Bidders may wish to execute a “PLUS 1” bid. All absentee bids will be bid competitively with an attempt to start the initial bid in the auction hall. All absentee bidders will be required to pay 50% of the left bid should competitive bidding fall short of that figure.
2) For phone or absentee bidding:
Please fill out a form during our preview or Phone (207) 548-2393 at least 24 hours before the auction to arrange to phone bid. We will need the following information:
A) YOUR FULL NAME APPEARING ON THE CREDIT CARD
B) THE CORRECT MAILING OR DELIVERY ADDRESS
C) THE PHONE NUMBER WHERE WE MAY CONTACT YOU
D) A VALID VISA , MASTER CHARGE, OR DISCOVER  NUMBER, EXPIRATION DATE, PIN NUMBER & CARD HOLDERS ADDRESS.
E) NAME THE ITEM(S) YOU ARE INTERESTED IN AND ASK ANY QUESTIONS YOU MAY HAVE CONCERNING THESE ITEMS SUCH AS ESTIMATES, CONDITION ETC. WE WILL TRY TO ANSWER ANY QUESTIONS, BUT THE BUYER IS ALWAYS RESPONSIBLE FOR INDEPENDEBTLY VERIFYING AGE, CONDITION, AND AUTHENTICITY BEFORE LEAVING A BID OR ARRANGING FOR A PHONE BID.
F) STATE THE AMOUNT OF YOUR ABSENTEE BID AND WHETHER YOU WISH TO EXECUTE A “PLUS 1” BID.
G) WE WILL NEED TO KNOW IF YOU ARE AN IN-STATE OR AN OUT-OF-STATE DEALER FOR TAX PURPOSES.
H) IF YOUR BIDDING IS BY PHONE, WE WILL CONFIRM A TIME THAT WE WILL CALL YOU.
I) ALL SUCCESSFUL ABSENTEE AND PHONE BIDDERS WILL BE CONTACTED WITHIN SEVERAL DAYS OF THE AUCTION.
